This privacy policy (” Privacy Policy”) applies to all personal information collected through and/or processed in connection with http://www.3D Berg.com (the ” Website”), the services provided by 3D Berg, and verbal, email, text, and other electronic communications between you, our Website, and/or 3D Berg personnel.
3D Berg legal entity under 3D Berg Ltd. When we refer to “3D Berg,” “we,” “us,” or “our” in this Privacy Policy, we are referring to the applicable 3D Berg group entity.
This Privacy Statement describes how we collect and use your personal information when you visit our website or use our services. Unless otherwise defined in this Privacy Statement, terms beginning with capital letters have the same meaning as in our General Terms of Sale. All additional terms, policies, and guidelines, including our General Terms of Sale and Terms of Use, are incorporated by reference into this Privacy Statement.
We may function as a data controller or processor under the General Data Protection Regulation (Algemene Verordening Gegevensbescherming).

Our users

Our websites, applications, products, and services are created with businesses and their representatives in mind. We do not target consumers, who seek to utilize our products and services for personal or domestic purposes. As a result, we treat all personal information we collect as pertaining to individuals in their capacity as businesspeople, not as individuals.

What we collect, Information you provide.

We may collect your first and last name, company name, company profile, postal address, email address, phone number, fax number, username, password, billing information, shipping information, tax registration status and number, and/or demographic information (such as your gender and/or occupation), in addition to any other information you provide directly on our Website.
We may collect information about your capabilities, capacities, and supply processes if you are a manufacturing partner.
If you are applying to join the 3D Berg team, we may collect your employment history, including your resume or CV, as well as additional links, such as portfolios and social media profiles.

Private messages

You may send us private messages (including, but not limited to, text, verbal, images, videos, locations, and contact information) when using our services. We store these messages to improve our services and to comply with the law.

Information generated automatically

We automatically log information about you and your computer when you visit our website. This information may include IP addresses, browser type, browser language, browser settings, computer operating system type, the website you visited before visiting our Website, pages you viewed on our Website, the amount of time you spent on a page, access times, and information regarding your use of our Website and services. This information may also be collected using “cookies” in accordance with our Privacy Statement.
Each of the aforementioned categories of information constitutes your “personal information.” How we use your personal information and for what purposes We may use your personal details in the following ways:

  • to provide our services to you  
  • to facilitate any communication required for delivery of our services, including sharing your  personal information as necessary to fulfill your Order;  
  • to operate, maintain, and improve our Website, products, and services;
  • to respond to  comments and questions and provide customer service;
  • to send information including  confirmations, invoices, technical notices, updates, security alerts and support and  administrative messages;  
  • to communicate about promotions, upcoming events, and other news about products and  services offered by us and/or our selected partners;

  • to protect, investigate, and deter against fraudulent, unauthorized, or illegal activity;
  • to respond to lawful requests and legal processes;  
  • to protect the rights and property of the 3D Berg companies, our agents, customers, and  others, including enforcing our agreements, policies, and terms of use and sale; and/or
  • in  an emergency, this includes protecting the safety of our employees and agents, our  customers or any person. 

We may share your personal details in the following ways:
Your personal information may be shared with the following parties:

  • our subsidiaries, affiliates and any ultimate parent company; 
  • our contractors, service providers and other third parties that we use to support our business  and who are bound by contractual obligations to keep personal information confidential  and use it only for the purposes for which we disclose it to them; and/or 
  • a buyer or other successor in the event of a merger, divestiture, restructuring,  reorganization, dissolution, or other sale or transfer of some or all of 3D Berg’ assets, or  negotiation of such a business deal, whether as a going concern or as part of bankruptcy,  liquidation, or similar proceeding, in which personal information held by 3D Berg is among the  assets transferred. 

We may share your personal data with your permission. You may, for instance, authorize us to share your personal information with third parties for their own marketing purposes. These uses will be subject to the respective third parties’ privacy policies.
Additionally, we may share aggregated and/or anonymized data with third parties for their own purposes. The controlling and/or processing of your personal data is predicated on the following criteria:

  • your consent;  
  • the preparation or performance of an agreement with you;  
  • compliance with a legal obligation;  
  • our legitimate interests, namely, to provide our services to you, to resolve disputes or legal  procedures or for statistical reasons, to improve our services, to negotiate an acquisition,  to evaluate your application for employment, for direct-marketing purposes and/or public  relations. 

We may be required by law or contract to process your personal information. The processing of your personal information may also be required for the conclusion of a contract with you. In these instances, we cannot continue our relationship with you unless you provide the necessary personal information.
How long we retain your personal data
We retain your personal information only as long as necessary to fulfill the purposes outlined in this Privacy Statement.
When we process your personal information based on your consent, we will only retain it for as long as necessary or until you revoke your consent, whichever comes first.
When we process your personal information based on the preparation or performance of a contract with you, we will keep your personal information for up to seven years following the expiration of the contract or the resolution of the dispute, whichever is later.

When we process your personal information in order to comply with a legal obligation, we will store your personal information for the period of time required by law. We will retain your personal information for no longer than the statute of limitations applicable to any potential legal claim we may have against you. We will store your judgments against us for twenty years.
When we process your personal information in response to your application for employment at 3D Berg, we will anonymize it after three months or when the position has been filled. For applicants prior to May 25, 2018, we will anonymize your personal information three years after submission. In each instance, candidates may opt-in to continue communication for up to one year.
Depending on the cookie type, we will keep your personal information for up to two years.
Information options and alterations
When we process your personal information based on your consent, you have the right to revoke it at any time.
Our marketing emails contain instructions on how to “opt-out.” We may still send you non-marketing emails if you opt out. Included in non-marketing emails are messages regarding your accounts and our business dealings with you.
Our contact information regarding requests for personal information is provided below. You can request to change your contact preferences, opt out of information sharing, and/or update your personal data.
Typically, you can remove or reject cookies from our website by adjusting your browser settings. Many browsers are initially configured to accept cookies unless you change the settings. Third-Parties 

We rely on third parties to carry out duties on our behalf. Examples include, but are not limited to, hosting services, customer relationship management, analytics, personalized ad creation and implementation, billing, tax calculation, address validation, storage and conversion services for uploaded 3D or other technical drawings, and payment processing services. These parties may process your personal information to the extent required to perform these functions on our behalf and in accordance with our instructions. There are safeguards in place to ensure that these third parties respect your privacy.
Our partners may collect data and employ cookies for ad measurement and personalization. These third parties may be located in either the EU/EEA or the United States (” US”). If we transfer your personal information outside of Europe to a country that the European Commission has not deemed to provide an adequate level of protection for personal information, the transfer will be carried out as follows:

  • pursuant to the recipient’s compliance with standard contractual clauses, the EU-US  Privacy Shield (or Swiss-US Privacy Shield, as applicable), or Binding Corporate  Rules;  
  • pursuant to the consent of the individual to whom the personal information pertains;  and/or  
  • as otherwise permitted by applicable European requirements.

Consequently, it is possible that a different privacy policy applies to the use of these third-party websites. This Privacy Statement applies solely to information collected via 3D Berg services and our website. We disclaim all responsibility and liability for the operation and/or content of third-party websites. You may also share personal information with others using the 3D Berg service. You are responsible for the information you share using 3D Berg’s services. 3D Berg assumes no liability or responsibility for this type of sharing.

We may store information in the form of so-called “cookies” on your device, such as your computer, to make our website and services more user-friendly and efficient. A “cookie” is a string of text that is temporarily or permanently stored on your computer when you visit a website.

We acknowledge our obligation to safeguard the information you entrust to us. We have taken precautions to protect your personal information against accidental loss and unauthorized access, use, modification, and disclosure.

Your rights

However, if we have compelling legitimate grounds that override your interests or if the processing is necessary for the establishment, exercise, or defense of legal claims, we may deny your request.
Before providing you with access to your personal information, we reserve the right to verify your identity for security purposes. We will provide a free response to your request, but we reserve the right to charge a fee if it is deemed excessive or manifestly unfounded.
Your request to exercise your rights can be sent to legal@3D Berg.com. Please ensure that your email is as clear and precise as possible. Please specify which rights you wish to assert and the basis(s) for doing so. We will respond to your request within one month of receipt, unless additional time is required. Then, within one month of receiving your request, we will let you know that we need up to two additional months. Within this timeframe, we will inform you whether or not your request will be fulfilled. If we are unable to accommodate your request, we will explain why.

Together, we can attempt to identify and address the cause of your complaint. You may at any time file a complaint about our privacy practices with the appropriate regulatory agency. Changes to this Privacy Policy 

This Privacy Statement is subject to change at any time. If we make material changes, we may notify you by sending an email to the most recent e-mail address you provided us (if any) and/or by prominently posting notice of the changes on our Website. You are responsible for giving us your most up-to-date email address. In the event that the last e-mail address you provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nevertheless serve as effective notice of the changes described in the notice. These modifications take effect immediately for new users of our website. Your continued use of our website after receiving notice of such modifications signifies your acceptance of such modifications and agreement to be bound by their terms and conditions. If you are not a new user and/or do not use our Website for thirty (30) calendar days following our dispatch of an e-mail notice to you (if applicable) or thirty (30) calendar days following our posting of the changes on our Website (if applicable), then the expiration of the thirty (30) days will signify your acceptance of the changes and agreement to be bound by the terms and conditions of the changes.

Children’s Privacy 

COPPA (Children’s Online Privacy Protection Act) compliance is a priority for us. Our website and services are not intended for children under 16 years old. We do not intentionally collect personal information from children younger than 16 years old. If we discover that a child under the age of 16 has provided us with personal information, we will promptly delete that information. Schools and parents should monitor their children’s online activities and consider implementing additional safeguards to ensure a child-friendly online environment.
