Unless otherwise defined in this Privacy Statement, terms beginning with capital letters have the same meaning as in our General Terms of Sale. All additional terms, policies, and guidelines, including our General Terms of Sale and Terms of Use, are incorporated by reference into this Privacy Statement.
We may function as a data controller or processor under the General Data Protection Regulation (Algemene Verordening Gegevensbescherming).

Our users

Our websites, applications, products, and services are created with businesses and their representatives in mind. We do not target consumers, who seek to utilize our products and services for personal or domestic purposes. As a result, we treat all personal information we collect as pertaining to individuals in their capacity as businesspeople, not as individuals.

What we collect, Information you provide.

We may collect your first and last name, company name, company profile, postal address, email address, phone number, fax number, username, password, billing information, shipping information, tax registration status and number, and/or demographic information (such as your gender and/or occupation), in addition to any other information you provide directly on our Website.
We may collect information about your capabilities, capacities, and supply processes if you are a manufacturing partner.
If you are applying to join the 3D Berg team, we may collect your employment history, including your resume or CV, as well as additional links, such as portfolios and social media profiles.

Private messages

You may send us private messages (including, but not limited to, text, verbal, images, videos, locations, and contact information) when using our services. We store these messages to improve our services and to comply with the law.

Information generated automatically

We automatically log information about you and your computer when you visit our website. This information may include IP addresses, browser type, browser language, browser settings, computer operating system type, the website you visited before visiting our Website, pages you viewed on our Website, the amount of time you spent on a page, access times, and information regarding your use of our Website and services.   • in  an emergency, this includes protecting the safety of our employees and agents, our  customers or any person.

Your personal information may be shared with the following parties:

  • our subsidiaries, affiliates and any ultimate parent company; 
  • our contractors, service providers and other third parties that we use to support our business  and who are bound by contractual obligations to keep personal information confidential  and use it only for the purposes for which we disclose it to them; and/or 
  • a buyer or other successor in the event of a merger, divestiture, restructuring,  reorganization, dissolution, or other sale or transfer of some or all of 3D Berg’ assets, or  negotiation of such a business deal, whether as a going concern or as part of bankruptcy,  liquidation, or similar proceeding, in which personal information held by 3D Berg is among the  assets transferred. 

We may share your personal data with your permission. You may, for instance, authorize us to share your personal information with third parties for their own marketing purposes. These uses will be subject to the respective third parties’ privacy policies.
Additionally, we may share aggregated and/or anonymized data with third parties for their own purposes. The controlling and/or processing of your personal data is predicated on the following criteria:

  • the preparation or performance of an agreement with you;  
  • compliance with a legal obligation;

We may be required by law or contract to process your personal information. The processing of your personal information may also be required for the conclusion of a contract with you. In these instances, we cannot continue our relationship with you unless you provide the necessary personal information.
How long we retain your personal data
We retain your personal information only as long as necessary to fulfill the purposes outlined in this Privacy Statement.
When we process your personal information based on your consent, we will only retain it for as long as necessary or until you revoke your consent, whichever comes first.
When we process your personal information based on the preparation or performance of a contract with you, we will keep your personal information for up to seven years following the expiration of the contract or the resolution of the dispute, whichever is later.

When we process your personal information in order to comply with a legal obligation, we will store your personal information for the period of time required by law. We will retain your personal information for no longer than the statute of limitations applicable to any potential legal claim we may have against you. We will store your judgments against us for twenty years.
When we process your personal information in response to your application for employment at 3D Berg, we will anonymize it after three months or when the position has been filled. For applicants prior to May 25, 2018, we will anonymize your personal information three years after submission. In each instance, candidates may opt-in to continue communication for up to one year.
Depending on the cookie type, we will keep your personal information for up to two years.
Information options and alterations
When we process your personal information based on your consent, you have the right to revoke it at any time.
Our marketing emails contain instructions on how to “opt-out.” We may still send you non-marketing emails if you opt out. Included in non-marketing emails are messages regarding your accounts and our business dealings with you.

Please specify which rights you wish to assert and the basis(s) for doing so. We will respond to your request within one month of receipt, unless additional time is required. Then, within one month of receiving your request, we will let you know that we need up to two additional months. Within this timeframe, we will inform you whether or not your request will be fulfilled. If we are unable to accommodate your request, we will explain why.
